Summary

- Family Law: Study the problems of the development of the family institution and the inadequacy of the law for resolving disputes that arise
- Alternative means of conflict resolution: In the "Justice2030 Plan", which refers to the United Nations 2030 agenda that includes peace and security among its 17 goals, one of them, SDG 16, focuses on "Promoting peaceful, just and inclusive societies". We focuses on the novelties proposed for the appropriate means of dispute settlement (ADR) included in its first title. This is the fundamental aspect of this reform. In fact, in our legal system there is already regulation, on the one hand, of mediation, regulated in Law 5/2012, of July 6 and in Royal Decree 980/2013, of December 13, on the other hand; of conciliation, referred to in Law 15/2015, of2 July, the Law of voluntary jurisdiction, also taking into account that, the laws of prosecution provide for the conciliatory activity of the courts at various moments of the procedure. In mediation and conciliation (now called private conciliation) there are modifications at the same time that new aspects are regulated and other appropriate means of dispute resolution are proposed, such as the confidential binding offer, the opinion of an independent expert, and those established in the special legislation, but it also leaves the door open to the introduction of other negotiation channels.
